Triumph of the Heart Screenings Summary

What We Do: We help fans bring Triumph of the Heart to their local theater by pooling contributions and working with a movie distributor to book a venue.

How Campaigns Work: Campaigns must hit their funding goal (e.g., $1,500) before a screening can be booked. If the goal isn’t met, you’ll get a full refund or can “Give Forward” your contribution to another campaign.

Tickets: Tickets are only issued after the theater booking is confirmed. Once confirmed, tickets are transferable but non-refundable.

Hosts: Hosts receive 5 tickets if the campaign reaches its funding goal and are the main contact for theater preferences.

Cancellations: If a screening is canceled or the distributor can’t book your preferred date option, we’ll offer a refund or alternative options. We don’t provide refunds for no-shows or scheduling conflicts.

Liability: We’re only the facilitator and payment agent, so we’re not responsible for theater closures, distributor failures, or events canceled due to circumstances beyond our control (e.g., bad weather, pandemics).

Terms and Conditions: Facilitation of Crowdfunding Campaigns and Ticket Fulfillment

1. Introduction

These Terms and Conditions ("Terms") govern the role of Triumph of the Heart ("Facilitator," "we," "our," or "us") in facilitating the sale and distribution of movie tickets through the Crowdfunding Screening Platform ("Platform"), which operates as a crowdfunding and ticketing platform. By participating in any ticket purchase, campaign, or related activity, you ("User," "Backer," "Buyer," or "Host") agree to these Terms in full.

2. Role of the Facilitator

2.1 We act solely as an intermediary and payment collection agent between the ticket provider (cinema, distributor, rights holder, or designated distribution agent, collectively the "Distribution Agent") and the User.
2.2 We are responsible for collecting ticket sale proceeds on behalf of the Distribution Agent, who will book the theater and pay the theater operator for the screening.
2.3 We coordinate with the Distribution Agent regarding User preferences (e.g., screening date, time, and location); however, the Distribution Agent is solely responsible for:

  • Booking theaters and securing venues,

  • Paying theater operators,

  • Confirming event details.

2.4 All ticket sales, pricing, and availability are subject to the terms and conditions of the Distribution Agent, the ticket provider, and the theater operator.

2.5 We do not guarantee the fulfillment of any screening or campaign, as this depends on the Distribution Agent’s obligations and theater availability.

3. Responsibilities of the Facilitator

3.1 We act only as a payment collection agent and do not operate as the ticket provider, theater operator, or Distribution Agent.
3.2 Our responsibilities are limited to:

  • Collecting and transferring funds to the Distribution Agent,

  • Communicating campaign status, booking updates, and ticket confirmations to Users.

3.3 We are not liable for cancellations, delays, venue unavailability, or any issues beyond our direct control, including those caused by the Distribution Agent, theater operator, ticket provider, or campaign organizer.

4. Obligations of the Distribution Agent

4.1 The Distribution Agent is fully responsible for:

  • Booking and securing theaters,

  • Paying theater operators for screenings,

  • Confirming all event details (date, time, and venue).

4.2 The Distribution Agent will make reasonable efforts to accommodate User preferences but cannot guarantee specific dates, times, or locations, as these depend on theater availability.

5. User Responsibilities

5.1 Users must provide accurate and complete information when purchasing tickets or contributing to a campaign, including preferred screening locations and contact details.
5.2 Users must comply with all theater operator requirements, including age restrictions, entry policies, and seating arrangements.
5.3 Tickets are not intended for resale. Users are responsible for consulting local city and state laws and regulations, the terms and conditions of their theater, and required taxes should they wish to pursue reselling tickets. Facilitator is not responsible for what happens to tickets once they are passed to the buyer.
5.4 Users are responsible for checking campaign and screening updates sent by us or the Distribution Agent.

6. Crowdfunding Campaigns

6.1 Campaign contributions are pooled to secure a screening of Triumph of the Heart in the location specified by the Host or contributing Users.
6.2 A campaign must reach its funding threshold (e.g., $1,500) before tickets and theater bookings are booked and confirmed.
6.3 If a campaign is funded:

  • We will coordinate with the Host to select a preferred theater, subject to availability.

  • Tickets will be issued directly by the theater or its designated ticketing system.

  • All contributions become non-refundable (except as stated in Section 8).

6.4 If a campaign does not reach its funding goal, Users will be given the option to:

  • Give Forward their contribution to the national pool of Give Forward tickets for priests, religious, seminarians, missionaries, and students, or

  • Receive a full refund (see Section 8).

6.5 Host Benefits & Responsibilities: (see Host Addendum in Section 15 for more detail)

  • Hosts receive 5 tickets upon successful funding.

  • Hosts are responsible for distributing or using their reserved tickets.

  • Hosts must communicate their preferred theaters promptly once the campaign is funded.

  • Campaigns that do not reach the funding goal will not be booked (see Section 8)

7. Campaign Contribution Funds and Ticket Purchases

7.1 Funds collected by the Facilitator through the crowdfunding campaigns are used to purchase tickets through the Distribution Agent and to pay for additional costs associated with the nationwide Militia Crowdfunding Project.
7.2 Tickets will only be confirmed and issued once the theater is booked and paid for by the Distribution Agent.
7.3 Prices to “Reserve a Ticket” that are displayed for each campaign on the Platform are based on national average ticket prices, inclusive of taxes and fees unless otherwise stated.
7.4 Because regional pricing and taxation vary, we do not provide detailed per-ticket price breakdowns or tax disclosures. The Distribution Agent is the actual ticket seller and responsible for ticket pricing and taxation.
7.5 Tickets are transferable but non-refundable except as provided in Section 8.

8. Refunds, Cancellations, and “Give Forward”

8.1 If a campaign does not meet its funding threshold, Users may choose to Give Forward their contribution to another campaign or receive a full refund.
8.2 If the Distribution Agent cannot book the User’s preferred screening option, Users will be notified and may:

  • Accept an alternative option,

  • Give Forward their contribution, or

  • Request a full refund.

8.3 If a confirmed screening is canceled by the Distribution Agent, ticket provider, or theater operator, Users will be refunded in accordance with the ticket provider’s or Distribution Agent’s policies.

8.4 Refunds are not provided for:

  • User error (e.g., incorrect information, duplicate orders)

  • Personal scheduling conflicts

  • Failure to attend the event

  • Cancellations due to Force Majeure as provided in Section 9

9. Limitation of Liability & Disclaimers

9.1 We are a payment collection agent and are not responsible for the actions or omissions of the Distribution Agent, ticket provider, or theater operator.
9.2 To the fullest extent permitted by law, we disclaim all liability for direct, indirect, incidental, or consequential damages arising from ticket sales, campaign failures, venue issues, or event cancellations.
9.3 Force Majeure: We and the Distribution Agent are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, extreme weather, acts of terrorism, pandemics, labor disputes, power failures, internet outages, or government actions.
9.4 We are not responsible for third-party failures, including theater closures, Distribution Agent insolvency, or ticket provider system errors.

10. Intellectual Property

All content on the Platform, including campaign materials, branding, images, and text, remains the property of the respective rights holders. Users may not reproduce, modify, or distribute any such materials without prior written permission.

11. Privacy

We collect personal information like names, emails, phone numbers, and usage data to operate, market, and improve our website and services. This data may also be used to communicate with Users and send updates. We may share User’s information with trusted service providers. By using our site, Users agree to this collection and use of their information as described.

12. Amendments

We may update or modify these Terms at any time. Changes will be effective upon posting to the Platform, and continued use of the Platform constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed under the laws of Texas. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Texas.

15. Host Addendum (Additional Terms for Campaign Hosts)

15.1 As a Host, you agree to:

  • Act as the primary point of contact for your campaign.

  • Promptly provide us with your preferred theater locations after funding is achieved.

  • Accept responsibility for all tickets reserved through your contribution.

  • Distribute the 5 included Host tickets.

  • Assist with event promotion as reasonably requested.

15.2 Hosts must comply with all venue and ticket provider rules.

15.3 Failure to meet Host obligations may delay or prevent your screening.
